The Purpose of this Blog

Human dignity  represents the grounding of human rights and comes from different trends of thinking that can even go back to Antiquity. Nonetheless, and beside the importance of this value, it is often misunderstood and criticized because of the supposed vagueness of its meaning.  With this blog, I would like to share some of my reflexions concerning this notion, and from different points of view: history, philosophy, law, anthropology, ethics and culture. It is only through an open and constructive debate that we might be able to define and understand the concept of human dignity. Also, I would like to deal with other ideas, which are related to this notion, such as human rights, justice, the rule of law and democracy. Finally, I hope this blog may contribute modestly to the new civil society that has understood how internet in general and social networks in particular, are currently shaping new forms of knowledge and consciousness.

Human Rights Course: Syllabus

 

HUMAN RIGHTS (60 hours) 

 

 

 

This course is concerned with Human Rights regime through history and theory. In a first part, we will analyze the different conceptions of Human Rights, and its contemporary foundation in the value of human dignity. In a second part, we will discuss Human Rights throughout history, identifying, on the one hand, some basic historical processes, and, on the other, three historical Western approaches (France, England and the United States). In the third part, we will explore different international systems of Human Rights’ protection, with the objective to identify theirs mechanisms and evolutions. Finally, in the fourth part, we will focus on the current challenges that Human Rights are facing, and the solutions they provide to those questions.

 

At end of the course, the student will have acquired the understanding of:

 

-        The ethical, historical and political dimensions of Human Rights.

-        The relations between Human Rights, Democracy and the Rule of law.

 

He/she would also be able to analyze critically the discourse of Human Rights, and be able to build assertively his/her own opinion on the topic.

 

Teaching will be based on lectures and constant questioning and interactions with the students. Multimedia support will be used (all students should have a twitter account)

 

Assessment

 

Class participation: attendance and active participation in the discussions (30 % of the final grade) One short essay (6 pages) in lieu of mid-term. It is highly recommended to schedule with the instructor for clarification concerning the topic and the bibliography of the essay (30 %).

Course on Constitutionalism : Syllabus

 

 

CONSTITUTIONALISM (30 hours)

(2013-14)

 

 

This course will focus on the historical construction and theoretical explanations (and critics) of the idea of the State. We will seek to unpack legal and political debates over competing approaches on the legitimacy of the State, its relationships with law and Constitution, the challenges of the Rule of law and Democracy, and current controversies about judicial interpretations of the Constitution. The course will begin by examining the concepts of the State and law, through the reading of some “classic” texts on the topic. Then, we will examine the core features of the Rule of law, underlying its closed relationships with the recognition and adjudication of Human Rights. Eventually, we will critically consider theories concerning judicial interpretations of the Constitution, through the lenses of democratic ideals. 

At the end of the course, the student will have acquire the understanding of:

- The main political theories and historical influences over the discussions surrounding the topics we have examined during the course.

- The importance of judicial interpretations of the Constitution in promoting Democracy but also its inconvenient.

Kant & 50 cent: Dignidade (humana) e Autoconfiança #PucRio

 

 

 

Naquela aula de filosifia do direito (27.08.13), nós interessamos por as relações entre a dignidade humana, as idéias de vontade e de destino.

Estudamos o imperativo categórico  (IC) de Kant, com suas três formulações: sua forma (lei universal), sua matéria (tratar o ser humano com fim), sua determinação (o "reino dos fins"). 

Também, vimos a evolução da ideia de autoconfiança em Ralph W. Emerson, e o seu escrito "On Self Reliance" (1841) e  A 50ª Lei de Robert Greene (2009), livro inspirado na vida do artista 50 cent. 

Imperativo categórico e autoconfiança representam dois caminhos, não necessariamente opostos, para tornar o ser humano num indivíduo autónomo e consciente das suas capacidades. 

 

 

 

A dignidade humana como valor inerente e absoluto do ser humano

    Se pode entender e reconstruir as duas dimensões básicas da dignidade humana, como valor inerente e valor absoluto do ser humano, definindo suas características e avaliando a sua relevância para os direitos humanos. I. A dignidade humana como valor inerente ao ser humano se articula entre dois eixos. Em primeiro lugar, veremos i) as relações que existem entre a dignidade humana e a ideia de natureza humana. Em segundo lugar, a partir da premissa que converte a dignidade humana em algo inato e inseparável do ser humano (valor inerente), cabe questionar-se sobre ii) os titulares da dignidade.

    i) Para serem titulares da dignidade humana, os seres humanos compartilham supostamente da mesma natureza humana, também fonte de uma dignidade em condição de igualdade. Entretanto, esta concepção suscita vários problemas. Primeiro, faz derivar um valor (a dignidade) da descrição de um fenômeno (a natureza humana). Poderia incorrer no que se conhece por falácia naturalista[1]. Segundo, tal construção não garantiu a defesa e a proteção deste valor, daí a própria existência dos direitos humanos. Terceiro, a ideia de natureza humana não é filosoficamente neutra nem objetiva. Portanto, como fundamentar os direitos humanos a partir de uma ideia – a dignidade humana – que, por sua vez, requer um fundamento – a natureza humana – e que é também imprecisa? Se aceitarmos a ideia segundo a qual vivemos em um mundo onde a axiologia teria superado a ontologia[2], devemos perguntar-nos o seguinte: Em que medida fundamentar a dignidade humana em uma suposta natureza humana seria útil para reconhecer e desenvolver os direitos humanos? Como defende N. Bobbio: “da finalidade visada pela busca do fundamento, nasce a ilusão do fundamento absoluto, ou seja, a ilusão de que de tanto acumular e elaborar razões e argumentos - terminaremos por encontrar a razão e o argumento irresistível, ao qual ninguém poderá recusar a própria adesão”[3].

    ii) Quanto ao segundo eixo, os titulares da dignidade, são frequentes questionamentos como, por exemplo, os relativos ao estatuto dos embriões humanos ou das pessoas em coma cerebral: seria possível justificar a eutanásia com base na dignidade? É possível estender o conceito de dignidade aos animais? Um criminoso pode perder sua dignidade pela atrocidade de seus crimes? As gerações futuras têm direitos (como a proteção do meio ambiente) que devemos proteger? Diante dos desafios atuais dos direitos humanos, da justiça em um mundo globalizado, da bioética, das novas tecnologias, suscita-se com frequência a questão dos titulares da dignidade humana. Essas questões foram e continuam sendo estudadas sob vários enfoques. Por exemplo, a partir de ponto de vista ético, R. Dworkin, destaca as dificuldades de determinar os titulares da dignidade humana[4]. Ao contrário, partindo de um ponto de vista psicológico e evolutivo, P. Singer defende que a humanidade, graças ao sentimento de empatia, e como “circulo expansivo”, reconhece gradualmente um valor para todos os seres vivos[5].

II. Podemos reconstruir a dimensão absoluta da dignidade humana seguindo duas etapas. Na primeira, pretendemos entender i) como se pode tornar vulnerável a dignidade de um ser humano. Na segunda, veremos ii) casos de conflitos entre uma concepção objetiva da dignidade e a autonomia individual.

    Com relação ao primeiro aspecto, i) a vulneração da dignidade de um ser humano poderia ocorrer de duas maneiras: mediante sua instrumentalização, vulnera-se sua autonomia individual, enquanto que a humilhação vulnera sua integridade (física ou psicológica). Portanto, o caráter absoluto da dignidade humana implica na não-instrumentalização (de caráter kantiano) e a não-humilhação (de tipo humanista). A modo de ilustração, podemos citars o caso Oliver Brüstle v. Greenpeace e.V. de 2011, a Corte de Justiça da União Europeia censurou a possibilidade de se registrar a patente das células-mãe evocando o princípio de dignidade humana que proíbe a comercialização de partes do corpo humano[6]. Neste sentido, a dignidade humana não se aplica realmente a um ser humano em particular, mas ao conjunto da natureza humana. Além disso, este valor impõe um limite à liberdade de pesquisa científica. Temos aqui a utilização da dignidade humana como princípio de não-instrumentalização. Por sua vez, no assunto Shennawy contra França de 2012, a Corte Europeia de Direitos Humanos condenou a França por não respeitar a dignidade humana devido às condições desumanas e degradantes de suas prisões[7]. Nesta sentença, temos o uso da dignidade humana como princípio de não-humilhação, cujo fim consiste na proteção da integridade física e moral do indivíduo.

    ii) Sobre casos nos quais entram em conflito uma concepção objetiva da dignidade e o valor de autonomia individual, podemos citar o exemplo da prática do chamado “lançamento de anões” (midget tossing), que foi considerado um atentado à dignidade humana, apesar do consentimento do interessado. O juiz considerou que o valor da dignidade humana estava fora do comércio e seu respeito fazia parte da ordem pública (outro bem jurídico). Utilizar uma pessoa como projétil vulnera sua dignidade, mesmo quando esta consente e não sofre nenhum dano[8]. Existe aqui um conflito entre uma concepção objetiva da dignidade humana (interpretada pelo juiz) e o exercício da liberdade individual[9]. Deveremos verificar se, como sustentam alguns, o conceito de dignidade humana representaria, em alguns casos, um perigo para os próprios direitos humanos[10].
